GENERAL AND SPECIFIC TERMS AND CONDITIONS OF SALE (GTC)
Between SAS IGUANE HOUSE, Route du Flibustier – Fonds Thézan – 97180 Sainte Anne, with a share capital of €5,000, registered with the Pointe-à-Pitre Trade and Companies Register under number 2016B1315, SIRET 822 543 245 00010, represented by Ms. Valérie FRADOT, in her capacity as President, duly authorized for the purposes hereof. The company can be contacted by email by clicking on the contact form accessible via the website's homepage. Hereinafter referred to as the "Seller," the "Company," or the "Service Provider."
On the one hand, and the natural or legal person purchasing products or services from the company, hereinafter referred to as "the Buyer", or "the Client", or "the Lessee"."On the other hand, the following has been stated and agreed upon: Preamble"
The Seller publishes short-term tourist accommodation products and services exclusively for consumers, marketed through its website (https://www.iguanehouse.com). The list and description of the goods and services offered by SAS IGUANE HOUSE can be viewed on the aforementioned website.
Article 1: Purpose
These General and Specific Terms and Conditions of Sale define the rights and obligations of the parties within the framework of the online sale of products offered by the Seller.
Article 2: General Provisions
These General Terms and Conditions of Sale (GTC) apply to all sales of Products made through the websites of SAS IGUANE HOUSE, which form an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable General Terms and Conditions of Sale are those in effect on the date of payment (or the first payment in the case of multiple payments) of the order. These General Terms and Conditions of Sale are available on the Company's website at the following address: www.iguanehouse.com. The Customer declares having read and understood all of these General and Specific Terms and Conditions of Sale and accepts them without restriction or reservation. The Customer acknowledges having received the necessary advice and information to ensure the suitability of the offer to their needs. The Customer declares being legally capable of entering into a contract under French law or being duly authorized to represent the natural or legal person on whose behalf they are acting. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Article 3: Rental Agreement
The rental agreement is reserved exclusively for the use of furnished tourist accommodation. The parties declare that the lease does not concern premises rented for use as a primary residence, secondary residence or residential accommodation.
No person not named in the lease agreement is permitted without the seller's authorization. The tenant agrees not to sublet the property, to use the premises peacefully, and to obtain insurance against rental risks such as theft, fire, and water damage.
Article 4 : Length of stay
The tenant signing the contract concluded for a fixed term shall under no circumstances be able to claim any right to remain on the premises after the end of the stay.
Article 5: Conclusion of the contract
- For any booking made 31 days or more before the key handover, the tenant will pay a deposit equal to 50% of the rental amount; the balance will be due no later than 30 days before the arrival date. The booking is considered final upon receipt of the deposit.
- For any booking made 30 days or less before the start of the stay, the deposit is equal to 100% of the rental amount. The full rental price must therefore be paid at the time of booking.
- For all short-term bookings (6 nights or less), the deposit is equal to 100% of the rental amount. The full rental price must therefore be paid at the time of booking.
- the rental offer (also called "Vouncher") received by the tenant constitutes a rental agreement.
Article 6: Price of the stay
6.1 The price includes:
- The rental of equipped and furnished accommodation,
- the "end-of-stay cleaning" package (€120 in a 2-bedroom villa – €60 in a 1-bedroom villa – €80 in a suite)
unless otherwise specified in the offer (special or promotional offers),
- Garden and pool maintenance,
- Household linen:
SINGLE BED: 1 fitted sheet, 1 flat sheet, 2 pillowcases and 2 towels (1 large, 1 small)
DOUBLE BED: 1 fitted sheet, 1 flat sheet, 4 pillowcases and 4 towels (2 large, 2 small)
Shower room: 1 floor mat per shower room
Kitchen: 4 tea towels
- Water, gas, electricity and Wi-Fi internet consumption,
- On request: ironing board and iron.
6.2 The price does not include:
- Tourist tax (€1.50/person/night),
- Cancellation insurance (taken out by the tenant),
- Additional options such as: Arrival dinner, breakfast or other meal services served in the villa, cleaning during the rental period, wellness and relaxation treatments, access to the spa…
- the security deposit (€1500/2-bedroom villa – €1000/1-bedroom villa)
- Additional services resulting from a voluntary or involuntary extension of the stay (early arrival, weather and/or health conditions, etc.): these are at the client's expense based on the current rate.
Article 7 : Payment for items not included in the rental price
7.1 Application fees
For all bookings (stays or services), a processing fee (also called a service fee) of 3.6% of the total amount due will be charged. This fee covers the administrative processing of the booking and the security of the online payment.
These processing fees are in addition to the amount of the rental and/or services ordered. They are due at the time of booking or purchase of services and are non-refundable regardless of the reason for cancellation.
7.2 Tourist tax
The tourist tax is collected on behalf of the Riviera du Levant (a group of municipalities including Sainte Anne) and is not included in the price of the stay. It must be paid on arrival at the property no later than the day the tenant arrives.
Its cost: €1.50/person/night in furnished tourist accommodation *** on Sainte Anne.
7.3 End-of-stay cleaning fee
It is mandatory. If it is not included in the rental price, it can be paid at the time of the rental balance or at the latest on site on the day of arrival when the keys are handed over.
7.4 Additional options
They can be settled at the time of the rental balance or at the latest on site on the day of the tenant's arrival on the premises.
7.5 Wellness services
Wellness services can be purchased separately (without a stay). Payment is then made at the time of purchase on the website.
7.6 The security deposit
It is settled by check made payable to SAS IGUANE HOUSE on the day the keys are handed over.
Article 8 : Booking Procedure
1) Accommodation can be booked directly on the website: https://www.iguanehouse.com/
from the "book" buttons or by entering the dates of stay and then launching the search from the "Search" button.
You can also contact us via email at iguanehouse@orange.fr or by phone at 0690 840 728 (from abroad +590 690 840 728). A rental quote will then be sent to your email address.
2) To confirm your reservation and establish the rental contract, we will need personal information: name, surname, postal address, telephone number (mobile).
3) The rental agreement, also called a "Voucher", will be drawn up and sent by email.
A villa reservation is confirmed upon receipt of the deposit payment corresponding to:
- 50% of the rental amount if the reservation is greater than or equal to 7 nights and takes place more than 31 days before the handover of the keys.
- 100% of the rental amount if the booking is for 6 nights or less, or is made 30 days or less before the key handover.
Payments can be made by bank transfer, credit card, holiday vouchers (ANCV connect).
Upon receipt of payment, the customer will be notified by email and an invoice will be drawn up and sent.
4) The booking confirmation email accompanied by the "Voucher" constitutes a seasonal rental contract.
Article 9: Settlement of the balance
The balance of the rental is paid no later than 1 month before arrival at the rental by bank transfer, credit card or holiday vouchers.
In the event that the balance of the rental is not paid on the day of taking possession of the premises, the service provider will again have access to the premises without having to reimburse the amount of the deposit paid.
Article 10: Cancellation by the customer
Any cancellation must be notified by registered letter or email addressed to SAS IGUANE HOUSE, route du flibustier – Fonds Thézan – 97180 sainte Anne Guadeloupe / email: iguanehouse@orange.fr The date of the cancellation will be the day on which the provider is notified by registered letter or email.
10.1 - The tenant will lose the deposit (as well as the processing fees) if he withdraws 31 days or more before the effective date of the lease (= date of arrival in the rental).
10.2 -If the tenant cancels between 30 days and the arrival date at the rental, the tenant will pay the difference between the deposit and the equivalent of the total rent for the stay as well as all the options requested.
10.3 - in case of no-show by the tenant: the entire stay booked and its options will be due.
10.4 - in case of early departure of the tenant: payment for the entire stay booked and its options will remain due.
10.5 - If the customer has not appeared on the date mentioned in the contract, after a period of 24 hours and without notification to the seller:
- This contract is considered terminated,
- the price of the service remains the property of the seller,
- the seller can dispose of their service.
Article 11: Cancellation by the seller
The seller pays the tenant double the sums already paid by the tenant at the date of the seller's withdrawal.
Article 12 :Tenant's Arrival/Departure
12.1 - Upon arrival, the client must arrive on the specified date and from the time indicated on this contract. In case of late or delayed arrival, the client must notify the company or its representative so that they can best organize the client's reception.
12.2 - Departures take place 7 days a week before 11:00 am.
The tenant is obligated to respect the villa's vacancy time (as the organization of cleaning and the time of making the villa available to the next guests depend on it) as well as the departure instructions written in the welcome booklet (dishes washed and put away, garbage and recyclables removed, etc.).
The security deposit can be refunded on the day of the client's departure. In this case, one hour will be required to complete the check-out inventory.
Article 13: Condition report and inventory
13.1 -Upon arrival at the rental property, the client has 24 hours to verify that the premises conform to the description provided and to report any discrepancies to the seller. After this period, the rented property will be considered free of damage upon the tenant's arrival.
13.2 - The move-out inspection and inventory will be carried out on the day of the tenant's departure so that the tenant can recover their security deposit in full if no damage or missing items are found. The tenant must then allow the seller one hour to complete this move-out inspection.
If any damage is found, IGUANE HOUSE SAS will retain the security deposit. It will carry out the necessary purchases and/or repairs to restore the property. It will provide the invoice(s) and return the security deposit, less the cost of the expenses incurred.
13.3 - In the absence of a joint inspection at the end of the rental period, the provider's failure to contest the condition of the property within 72 hours of the end of the rental period (tenant's departure time) will be considered acceptance of the property being returned in good condition with a complete inventory. The security deposit check will then be returned to the tenant by mail within 7 to 10 days of the tenant's departure.
Article 14: The security deposit
Upon arrival, the tenant pays a security deposit by check. This deposit is not cashed except for the purpose of restoring the premises to their original condition and/or carrying out various repairs. The amount of these deductions must be duly justified by invoices from the service provider. If the security deposit proves insufficient, the tenant agrees to pay the difference based on the supporting documents provided by the landlord.
This guarantee shall in no case be considered as a contribution to the rent.
If no damage is found after the check-out inspection, the security deposit will be fully returned to the tenant by mail within 10 days of their departure.
Article 15: Use of the premises
Iguane House Villas & Micro Spa is dedicated to rest and relaxation; therefore, parties and gatherings are not permitted. The tenant must ensure the peaceful enjoyment of the property, use it in accordance with its intended purpose, and maintain the premises properly.
All villas are 100% non-smoking. Guests may smoke in the garden if they wish, provided they do not disturb other guests (be mindful of the wind direction). Any violation will result in a fine equivalent to the cost of an additional night's stay, plus any applicable cleaning fees.
BBQs and deep frying are not permitted on the entire site.
Article 16: Accommodation Capacity
The occupancy is limited to the number and names of the people indicated in the contract for the entire duration of the stay. If the number of tenants exceeds the occupancy limit or the number of people stipulated in the rental agreement, the provider reserves the right to refuse entry to the premises (and therefore the tenant's acceptance of the rental) or to request a price increase. Any modification or termination of the contract will consequently be considered to be at the tenant's initiative, and no refund will be issued.
In the event of abuse, the service provider or their agent may demand immediate eviction and claim compensation for damages suffered. The same may apply in the event of a neighborhood disturbance.
Article 17: Animals
Pets (except service animals) are not allowed anywhere on the premises. If the tenant violates this rule, the owner may refuse the stay. In this case, no refund will be issued.
Article 18: Insurance
The tenant is responsible for all damages caused by their actions. They are required to have holiday rental insurance to cover these risks.
Article 19: Right of withdrawal
Pursuant to the provisions of Article L 221-28-12 of the Consumer Code, the services offered on the website www.iguanehouse.com (with the exception of gift cards and vouchers for wellness services) are not subject to the application of the right of withdrawal provided for in Articles L. 221-21 et seq. of the Consumer Code in matters of distance selling.
Consequently, services ordered on the website www.iguanehouse.com are exclusively subject to the cancellation and modification conditions provided for in these General Terms and Conditions of Sale and the Customer may not invoke the right of withdrawal.
Regarding gift cards and vouchers for wellness services, they are subject to a right of withdrawal: The buyer has a 14-day right of withdrawal from the date of purchase. In this case, and before the expiry of the withdrawal period, the buyer must send the seller an email expressing their intention to withdraw to the following address: iguanehouse@orange.fr
The customer will then be reimbursed for their purchase, excluding processing fees (see article 7.1 of these Terms and Conditions).
Article 20: Telephone solicitation
Customers have the option to register on the Bloctel telephone marketing opt-out list via the website https://conso.bloctel.fr
Article 21: Disputes / Applicable Law
This text is governed by French law. Any dispute relating to its interpretation and/or execution shall be subject to the jurisdiction of the French courts.
